Closing the Year on Crime & Punishment

Killing Killers wishes everyone the very best of fortunes for 2013 and is closing out the calendar of 2012 on a light note today, since this year's news has been so heavy.
 
CRIME & PUNISHMENT
 
It might appear, from the photo above, that these two bashful teenagers were in the midst of a tryst of sorts and got busted by their peers.
 
But take a closer look and you'll see it just isn't so. The boys are merely getting their comeuppance for doing what some boys seem to do so well: brawling in the schoolyard.
 
Most school administrators take the view that fighting is a very serious crime no matter how old or young the perpetrators. Consequently, it's the kind of conduct that usually amounts to suspension as the swiftest and most appropriate form of punishment.
 
Of course, as in the real criminal justice system, determining just how long somebody should get banned from attending their classes usually depends on whether it's his first offense or if it's part of a troubling pattern.
 
Two days, a week, a month, forever...despite what most students loudly say about this in the presence of their friends, it's actually not their number one objective. Suspension from school for any length of time, or worse even permanently, is not ideal in the long run.
 
In fact, apart from being a lonely experience much akin to being publicly shunned, most kids can easily comprehend it's a real academic hassle as well. Especially those who have plans to graduate and get somewhere in life.
 
That's what the principal of Westwood High School in Mesa Arizona was figuring when he stumbled upon Charles and Julio above engaged in all out fisticuffs on school grounds. He broke their fight up and gave each young man the option to be suspended for the squabble or, alternately, to simply hold hands for an hour and be done with it.
 
A picture's worth a thousand words---you can see what these two intelligent youngsters prudently decided between them.
 
Leading up to this particular day in Westwood history, principal Timothy Richards had been highly praised for his somewhat maverick approach to student tardiness, delinquency, and other educational problems running rampant at Westwood before he was hired.
 
Indeed, during his brief tenure there, Richards' innovative policies were credited for thwarting the scholastic failure of some 300 students at the high school. Although not by forcing them all to hold hands, naturally.
 
For this particularly inventive method, however, the man has drawn some fire and ire. Not from Julio and not from Charles, mind you, but from critics on both sides of the isle.
 
But, regardless of this controversy over whether the punishment fits the crime or is way over the top and socially "traumatizing", the youths made the final choice, and this time they used their heads and chose very well.
 
What's more, at least one of them claims to have learned a valuable lesson from this experience, and that would be an obvious one: "Don't fight in school," Charles told an inquisitive CBS reporter earlier this month.
 
Right.
 
His arch nemesis, Julio, appears to have crumpled a bit under days of ridicule and unwanted Facebook photo-sharing. But, last heard, he's back in classes again too, and not fighting.

Who do you believe the Long Island Serial Killer is?


When a high-profile series of murders go suddenly cold, public speculation and finger pointing can start to run rampant.
 
Such is the case with the Long Island serial killings, uncovered at Gilgo Beach in 2010 after a bizarre 911 call from a Craigslist call-girl named Shannon Gilbert led to her subsequent disappearance, a fumbled search, and her weird drowning.
 
The discovery of Gilbert's body and, with it, a dozen other similar victims, was a pretty hot story then, but it's one that has since begun to languish in the media as the Suffolk County Police Department remains either tight-lipped about the matter or utterly disinterested in apprehending a perp (or perps), for fear it's somebody they might know.
 
Nevertheless, the $25,000 reward SCPD is offering for information leading to the arrest of the "unsub" (Unknown Suspect) still stands...
 
No takers as yet, but, really, who is murdering prostitutes in the New York City district and then dumping their bodies in the remote, swampy regions of Long Island?
 
Is it, as rumored in the press, a local police surgeon with unsavory connections and questionable predilections? Or, perhaps, a rabidly misogynistic out-of-towner vacationing on Gilgo in the summer months? Or even a pair of former NYPD detectives with a hater agenda and really bad attitudes about women?
 
Or is it someone else completely?
 
Well, whoever this fiendish slayer is, they've got a pretty good knowledge of police forensics, apparently, and a rather pronounced and passionate dislike for workers in the sex trade, evidently.

No justice for Seth Bishop


Once again the Butcher of Braintree, Amy Bishop, has gotten away with murder, even though now a lifer in an Alabama prison after she pled guilty last month to the 2010 Huntsville campus massacre and avoided execution. 
 
Following her sentencing of life without parole in Huntsville, officials in Braintree Massachusetts announced this week they will not seek to prosecute her for intentionally killing her 18-year-old brother, Seth, in December of 1986.
 
Bishop, then 20, had as well fled the murder scene with the still loaded shotgun in her possession and attempted to carjack a local business with it. Thereafter, she actively resisted arrest and was being booked by officers on suspicion of murder when her well-connected mother intervened to stop it.
 
All records of the Braintree incident then mysteriously "disappeared" and it was not until Bishop went on a rampage in 2010, gunning down three of her fellow biology professors and injuring three others, that the shooting death of her brother was revisited. She was then indicted in Massachusetts for homicide and expected to stand trial there once the trial in Alabama had ended.
 
But, “we will not move to have her returned to Massachusetts,’’ Norfolk District Attorney Michael Morrissey has decided. “The penalty we would seek for a first-degree murder conviction is already in place."
 
Oh, yes, it's a can of worms all right, Mr. Morrissey--exposing the high level cover up of Seth Bishop's murder--but so what? The young man still requires and deserves justice after all these years. And those who aided and abetted his killer on that day, who helped set Amy Bishop free to kill again without so much as a spot on her record, should be tried and sentenced now as well. 
 
Justice can never be served in some secondhand, roundabout way.

Closure nearing for Huntsville Massacre


BISHOP MASS MURDER TRIAL BEGINS @ 10:00 AM TODAY:  Now that Dr. Amy Bishop has pled guilty to the Huntsville Alabama campus rampage she planned and executed in 2010, she no longer has to fear the death penalty; nor will she be able to bog down Alabama's cash-strapped justice system with proving her insanity defense. Sane or not, doesn't matter anymore. But because she faces, instead, life without parole for slaying three of her fellow biology professors and wounding three more, she must still sit through an abbreviated trial for sentencing purposes. That finally begins today.
 
Whatever the final legal disposition of this contest should be, it's not the last we'll hear from or about The Butcher of Braintree, since she'll also have to face trial in Massachusetts soon for the 1986 murder of her younger brother Seth. Breaking news regarding that matter, and all other Bishop updates, will continue to be posted here on Killing Killers.

Jury selection begins in Huntsville Massacre


Lawyers for Dr. Amy Bishop, the Butcher of Braintree, are preparing their strategy for selecting sympathetic jurors in her upcoming capital murder trial later this month. Bishop is charged with gunning down her fellow professors at the University of Alabama at Huntsville in 2010 and faces the death penalty in Alabama if convicted.
 
There are two separate phases of the trial that her defense team has to concern themselves with now: presenting the evidence, which for Bishop is quite damning, and the sentencing aspect itself. They're seeking to mitigate the case for capital punishment against their client with an insanity plea, and, thus, hoping to find jurors who are receptive to the alternative of life in prison without parole.
 
Lawyers from both sides are permitted a certain number of strikes when selecting prospective candidates from the jury pool, establishing "cause" for eliminating  those individuals they feel are "incapable of being fair" either because they too strongly favor the death penalty or else are staunchly opposed to it on religious or philosophical grounds.
 
In the end, however, it's typical for jurors with either opposing point of view to be approved and seated, since they're under oath throughout the selection process and have sworn they can consider the facts of the case without bias.
 
But all this pretrial strategizing may prove for naught anyway because, according to Alabama law, a judge is not bound by a jury's sentencing recommendations. And, should this one feel that Bishop's penalty is too harsh or too lenient, they'll simply overrule it and substitute the form of justice they think is most appropriate.
 
A decision which can (and most likely will) be promptly appealed, considering that this is such a high profile case and that Bishop has also been charged with a separate homicide conviction for which she must still stand trial in Massachusetts, where she murdered her teenage bother Seth in 1986.

Drown victim's family offers $100,000 reward


The parents of Alexander Grant, the 19-year-old who mysteriously drowned last winter after attending a party in upstate New York and becoming separated from his friends, believe he was the victim of foul play and are now offering a $100,000 reward for information leading to the arrest and conviction of his murderer/s. Alexander’s suspicious drowning is one of the deaths featured extensively in my published report THE CASE OF THE DROWNING MEN. “We are Ken and Deanna Grant, the parents of Alexander Grant.  Alex died last year in Saratoga Springs, New York, after driving there to visit a friend who was attending college in the area.  His death has caused us more sadness than we can describe, and we are asking you to help us find the answers which we know must exist as to how Alex went from a dorm room to a house party and ended up dead some six hours later.  So far, all we have learned is that the events of his last night alive cannot be explained by what is currently known…
 This is why we are offering a $100,000 reward to the first person who comes forward with material information leading to the arrest and conviction of any person(s) responsible for causing Alex’s death.[i]  We know that Alex encountered many people on the night he died, and we hope and pray that you can help us learn how and why he died…
 After an extensive investigation of this tragedy, undertaken by the Saratoga Springs Police Department, the Saratoga County District Attorney, the New York State Medical Examiner and others, we are convinced in our hearts, minds and souls, that the key contributing factors leading to Alex’s death have not yet been disclosed.  We are not alone in our belief that Alex’s death cannot be explained by the official report of his death, issued in September 2011. Many of those involved in the investigation have also expressed their belief that material facts remain unknown.”

Amy Bishop murder trial (countdown)


Barring anymore legal wrangling by Amy Bishop's defense team, there is (finally) less than a month remaining until her trial for the Huntsville Massacre is slated to begin. The matter has been calendared for September 24th 2012.

Team Bishop has succeeded in putting off judgment day for well over a year now. However, with their most recent motion and appeal denied, there can be little else left for them to do but to proceed as directed--and to do so without expert testimony, if they must.

Expert medical testimony in support of her insanity plea is at the crux of Dr. Bishop's defense woes: She's lost her livelihood as a result of gunning her colleagues down at the University of Alabama, and, as an indigent in the court system, her lawyers contend she needs the fees for expert opinions paid up front.

The court has said no way, and the appeal of that decision was upheld last month.
 
Declaring yourself "not guilty of murder be reason of insanity" is a difficult defense to prove at best, let alone without doctors supporting the contention, so, rest assured, if Bishop gets sentenced to death in Alabama for lack of this required testimony, there will be mountains of appeals filed in hopes of having that verdict vacated.
 
So stay tuned. This should be an interesting contest, possibly paving the way for Bishop's separate trial in Massachusetts for the 1986 murder of her brother Seth. The date of which, like her fate, is still uncertain.

Amy Bishop murder trial

delayed again

Having been fired from her teaching post at the University of Alabama within hours of executing her colleagues in room 369 on the Huntsville campus, Amy Bishop lost not only her freedom on February 12th 2010, but her livelihood as well.
Bishop was the sole breadwinner of her household up until that time, and, faced then with defending herself in an Alabama courtroom against capital murder charges, she had no choice but to proceed as an indigent. Or, to put it in plain English, by filing for the benefits of poor person status.
Naturally, her defense team is not claiming Bishop’s innocence in the Huntsville Massacre. It is, after all, not exactly a whodunit—she was caught red handed—but rather a why and what for case. Was it an isolated act of revenge from having been denied tenure a few months prior, or is the defendant just a crazed killer who doesn’t know right from wrong?
With evidence subsequently having bubbled to the surface concerning other criminal deeds deeply hidden in Bishop’s past, including the murder of her own brother in 1986, her lawyers are contending it’s the latter, and are pleading the insanity defense on their client’s behalf. That means, even though the woman’s guilty as sin, a jury verdict of “not guilty by reason of insanity” will spare Amy Bishop from a death sentence.
Insanity is not a medical term, of course, but a legal one, so it does require expert testimony to support such a pleading. And that’s not going to be cheap…
Although legal analysts have doubted  from the start that this matter will ever actually go to trial, the costs of obtaining expert medical testimony is the crux of the issue presently at debate. And because, so far, the defense team has yet to find a reputable and affordable psychiatrist willing to uphold their own inexpert evaluation that Bishop is “a wacko” it’s the very reason why they’re deliberately procrastinating.
Bishop’s trial for mass murder was initially scheduled to begin on March 19th 2012, but then, on a motion filed by her attorneys, it was pushed way back to September 10th., presumably to allow more time for psychological testing, if it can be had for nothing.
As of the last week in July 2012, Team Bishop has once more succeeded in having the case postponed. This time it’s not quite the lengthy extension begged for and expected, but, still, those eager for the Bishop trial to get underway—such as her victims—will now have to wait until nearly the end of September for this, while her wily attorneys and the court itself can wrangle over who will pay the legal costs of her insanity defense, and when.
John Carroll, a former federal judge and current dean of the Cumberland School of Law warns, if the matter concerning Bishop’s alleged “entitlement” to a cost-free expert witness is not resolved in her favor and she’s actually sentenced to death, it’ll pave a clear path for mountains of appeals.
Justice delayed, justice denied.
Again.
